USCIS Increases Automatic Extension Period of Work Permits for Certain Applicants

May 3, 2022; USCIS has announced a Temporary Final Rule that grants Automatic Extension of Employment Authorization Documents (EADs) for Certain Renewal Applicants! The extension will be effective on May 4, 2022; increasing the 180 day extension to 540 days. This provides more certainty for businesses in retaining workers.


How should your business respond?

  • Identify who is eligible by looking at the categories on USCIS site

  • Understand the I-9 process and calendar expirations

  • Follow up with workers for ongoing employment authorization, which may include using this Auto-extension rule requiring them to provide evidence of pending EAD for extension of same classification (receipt notice).
